By downloading, installing, or using the FocusScore mobile application (the "App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you ("User," "you," or "your") and FocusScore, operated by Junsung Park / JunSoft ("we," "us," or "our").

You must be at least 13 years of age to use the App. If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that you have obtained parental or guardian consent to use the App and agree to these Terms. By using the App, you represent and warrant that you meet these eligibility requirements.

To access certain features of the App (such as cross-device sync and cloud backup), you must create an account. You agree to:

The App uses the front-facing camera exclusively for real-time focus analysis via Apple's Vision framework. Camera frames are processed in memory and immediately discarded after numeric metrics are extracted. No camera data is stored, recorded, or transmitted.
The App does not perform facial recognition or biometric identification. It detects gaze direction and posture orientation only. No faceprint, facial geometry hash, or biometric template is created.
You are responsible for informing anyone in your environment that the camera is active during a focus session. Do not use the App in settings where camera usage may violate the privacy expectations of others.

You retain full ownership of all focus session data generated through your use of the App ("Your Data"), including FocusScore values, trend history, and session records. We do not claim any ownership rights over Your Data.
By using the App, you grant us a limited, non-exclusive license to process Your Data solely for the purpose of providing the focus analysis service, syncing data across your devices (if enabled), and generating aggregated, anonymized insights to improve the service. We will never use Your Data for advertising or sell it to third parties.
FocusScore provides an estimate of concentration based on observable physical signals (gaze direction, head pose, posture). It is not a medical device and does not diagnose any condition. Focus scores are approximations and may not perfectly reflect your actual cognitive state. Do not rely on FocusScore for medical, clinical, or diagnostic purposes.

Prices are in US dollars and are subject to change with notice.
Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the renewal date. Your Apple ID account will be charged for renewal within 24 hours before the end of the current period at the confirmed purchase price.
You may cancel your subscription at any time through your Apple ID account settings (Settings > Apple ID > Subscriptions). Cancellation takes effect at the end of the current billing period; you will retain access to subscription features until that date. We do not offer prorated refunds for partial subscription periods.
If a free trial is offered, your subscription will automatically begin and billing will start at the end of the trial period unless you cancel before the trial expires.
All billing is handled exclusively by Apple Inc. through the App Store. We do not process or store your payment information. Refund requests must be submitted to Apple in accordance with Apple's policies.
We reserve the right to modify subscription prices. We will provide at least 30 days' notice before any price change takes effect. Your continued use of the App after a price change constitutes acceptance of the new price.

The App, including its design, code, user interface, brand elements, and scoring algorithms, is owned by us and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for personal use of the focus analysis service, in accordance with these Terms.
You may not copy, reproduce, distribute, create derivative works of, publicly display, publicly perform, or exploit the App or our intellectual property except as expressly permitted by these Terms or with our prior written consent.

Your use of the App is governed by our Privacy Policy, available at the link within the App and at support@focusscore.app upon request. By using the App, you consent to the data practices described in the Privacy Policy.

The App integrates with third-party services including Apple Sign In and Google Sign In. Your use of those services is subject to the respective third-party terms and privacy policies. We are not responsible for the practices of third-party services.

THE APP AND ALL CONTENT, SERVICES, AND FOCUS ANALYSIS RESULTS ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO:
Focus analysis is based on observable physical signals and provides estimated concentration metrics. Results may vary based on lighting conditions, camera angle, device model, and individual physical characteristics.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE, OUR OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:
IN JURISDICTIONS THAT DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, OUR LIABILITY IS LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.
OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.

You agree to defend, indemnify, and hold us harmless from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from: (a) your use of the App in violation of these Terms; (b) your violation of any third-party right, including privacy rights; (c) your use of the camera feature in violation of others' privacy; or (d) your violation of any applicable law.

You may stop using the App at any time. Deleting the App from your device does not automatically delete your account or cancel your subscription. Account deletion must be initiated within the App (Profile > Account Settings > Delete Account) or by contacting support@focusscore.app.
We reserve the right to suspend or terminate your access to the App at any time, with or without notice, for conduct that we determine, in our sole discretion, violates these Terms, is harmful to other users, is harmful to us, or for any other reason. Upon termination, your right to use the App ceases immediately.
Sections 5, 6, 9, 12, 13, 14, and 16 shall survive termination of these Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the App shall be resolved by binding arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, except that either party may seek injunctive relief in a court of competent jurisdiction for intellectual property infringement or unauthorized use claims. You waive any right to participate in a class action lawsuit or class-wide arbitration.

We reserve the right to modify these Terms at any time. When we make material changes, we will notify you via email or in-app notice at least 30 days before the changes take effect. Your continued use of the App after the effective date of revised Terms constitutes your acceptance of the changes.
